Peerless Network Applauds United States Court of Appeals Ruling
Decision Re-affirms Lower Court Ruling Invalidating Neutral Tandem Patent

CHICAGO--(BUSINESS WIRE)-- On January 30, 2012, the United States Court of Appeals for the Federal Circuit denied Neutral Tandem’s (TNDM) petition for rehearing of its appeal in its patent litigation with Peerless Network, Inc. The panel of judges from the appellate court issued an overwhelming, 3-0 ruling, on December 13, 2011, affirming the lower court’s ruling in favor of Peerless. The only option left for Neutral Tandem is to appeal to the United States Supreme Court. Barring the Supreme Court deciding to review the case, this ruling effectively ends Neutral Tandem’s attempt to foist this ill-fated patent on Peerless and the industry at large.
The speed with which the court acted is telling. It issued its initial affirmation order just days after conclusion of oral arguments. This reaffirmation decision was issued with extraordinary speed. Of course, these rulings relate back to the lower court’s decision, declaring Neutral Tandem’s patent invalid. The three Court decisions reinforce the US Patent and Trademark’s ruling invalidating Neutral Tandem’s Patent. The USPTO has invalidated all of the claims of the patent on multiple occasions. Peerless anticipates that this week’s action by the Court will bring the re-examination proceedings to a favorable close as well.
