Verizon takes 'win-back' fight to court

Verizon Communications has filed a petition with the U.S. Court of Appeals for the District of Columbia requesting a stay on last month's Federal Communications Commission ruling against Verizon in the 'win-back' fight. The FCC had ruled Verizon was not allowed to use information about its voice customers who were in the process of porting over to cable TV companies in order to attempt to win back those customers.

Verizon said it requested a stay from the FCC first, but the agency did not respond. Last month's ruling was based on a 4-1 vote, with FCC Chairman Kevin Martin as the dissenter. The ruling also was somewhat of a surprise, given that the FCC's enforcement bureau initially had indicated support for Verizon's position in the matter.
