When judges attack: Nacchio review proceeds

Former Qwest Communications CEO Joe Nacchio's fate is in the hands of a nine-judge appellate court panel that is reviewing whether or not an expert witness should have been allowed to testify for the defense. According to publications that covered the beginning of the panel's review on Thursday, Nacchio's legal team didn't get very far into its argument before the judges attacked it with a barrage of questions and counterpoints. The Justice Department prosecution team also felt some wrath from judges, though probably not as much, as it tried to argue its side of the matter.

The Denver Post quoted an expert saying the judge panel seemed to be leaning toward re-affirming Nacchio's conviction. A majority vote of the panel is required, and while Thursday's review session didn't last long, it is unclear how long the panel will take to issue a decision.
