The defense team representing former Qwest CEO Joe Nacchio in a civil fraud case brought by the Securities and Exchange Commission, filed arguments this week to have the lawsuit tossed out of court if the federal government is allowed to use the "state's secrets" privilege to keep Nacchio's lawyers from seeking government information and testimony.
Nacchio's legal team is looking for information they believe would support Nacchio's allegation that Qwest was denied government contracts after it refused to participate in the federal government's surveillance program.
