The 10th Circuit Court of Appeals in Denver wants to know why former Qwest CEO Joe Nacchio and former CFO Robert Woodruff were excluded from the class action suit that resulted in a $400 million settlement between Qwest and its shareholders. The exclusion means shareholders could pursue lawsuits against Nacchio and Woodruff individually, but they have appealed their exclusion, which in turn has held up settlement payments.
